Global Legal Debate on Israel’s Aid Blockade in Gaza Surges at World Court

As the world watches, a significant legal battle is unfolding at the International Court of Justice (ICJ) in The Hague, focusing on Israel’s refusal to permit humanitarian aid into Gaza. This week, dozens of nations are assembling to argue against Israel’s longstanding blockade, which has severely impacted the 2.3 million residents of the region.

The Humanitarian Crisis

Since 2 March 2024, Israel has entirely cut off supplies to Gaza, leading to dwindling food reserves after a brief ceasefire at the beginning of the year. The dire humanitarian situation has prompted a UN resolution, adopted by 137 of the 193 member nations, demanding Israel comply with international obligations to support the Palestinian population.

International Reactions

  • The United States, while backing Israel’s position, indicated that it believes an occupying power has some discretion regarding which humanitarian organisations can operate.

ICJ Hearings

For its part, the United States suggested that the legal framework allows Israel to restrict UN Palestinian refugee agency UNRWA’s operations, citing security concerns regarding its employees.

According to Joshua Simmons, legal adviser to the US State Department, “Even if an organisation offering relief is an impartial humanitarian organisation… occupation law does not compel an occupational power to allow and facilitate that specific actor’s relief operations.”

The deliberations may take months, after which the ICJ will issue an advisory opinion that, while not legally binding, carries substantial political weight. As the situation remains tense, it’s evident that the humanitarian needs in Gaza are growing critical.
